By accessing this website (www.swarvigyan.com), you agree to be bound by these Terms and Conditions ("Terms") in a legally binding agreement between us (Ram, "Merchant", "us", "we" or "our") and the User ("you" or "your"). Please read these Terms carefully before accessing or using the Website. If you do not agree to the Terms, you may not access the Platform. We reserve the right to update and change the Terms by posting updates on the Platform. You are advised to check the Terms from time to time. If any amendment is not acceptable to you, please stop using the Platform.

1. Eligibility

You represent and warrant that you have the right, power, and authority to agree to the Terms, to become a party to a legally binding agreement, and to perform your obligations under it.

2. Definitions

• "Payment Instrument" includes credit card, debit card, bank account, prepaid payment instrument, Unified Payments Interface (UPI), Immediate Payment Service (IMPS) or any other payment method offered by banks and financial institutions from time to time.
• "Platform" refers to the website where the Merchant offers its products and where the Transaction may be initiated.
• "Transaction" means the order placed by the User with the Merchant to purchase the product listed on the Platform by paying the Transaction Amount.
• "Transaction Amount" means the amount paid by the User in connection with a Transaction.
• "User" means any person availing the products offered on the Platform.
• "Website" means www.swarvigyan.com.

3. The product

The product sold on this Platform is Swar Vigyan (स्वर विज्ञान), a digital e-book in PDF format, priced at ₹399 as a one-time payment. No physical item is shipped. On successful payment, the PDF is delivered digitally as described in our Shipping & Delivery Policy.

The e-book is licensed to you for personal, non-commercial use only. You may not copy, resell, share, upload, or distribute the e-book or any part of it, in any form, without our written permission.

4. Nature of the content

The e-book presents traditional and spiritual knowledge of Swar Vigyan (breath science) as described in ancient texts such as Shiv Swarodaya. It is meant for education and self-study. It is not medical, legal, financial, or professional advice, and it does not guarantee any particular result in business, marriage, health, or any other area of life. Always consult a qualified doctor for any health condition.

5. Merchant's rights

You agree that we may collect, store, and share the information you provide in order to deliver the product you purchased and to contact you about it.

6. Your responsibilities

You agree to provide true, complete, and up-to-date information as required to complete the Transaction, including your name, email address, phone number, and accurate payment information.

7. Prohibited actions

You may not use the Platform for any purpose other than that for which we make it available. You agree not to:

• Systematically retrieve data or content from the Platform to build a collection or database without our written permission.
• Make unauthorized use of the Platform, including collecting user details for unsolicited email.
• Circumvent, disable, or interfere with security features of the Platform, or features that restrict copying of content.
• Trick, defraud, or mislead us or other users.
• Use scripts, bots, data mining, or similar tools on the Platform.
• Interfere with, disrupt, or create an undue burden on the Platform or connected networks.
• Impersonate another person, or use information from the Platform to harass or harm anyone.
• Copy, decompile, or reverse engineer the Platform's software.
• Upload viruses or any harmful material.
• Use the Platform in any way that breaks applicable laws or regulations.

8. Limitation of liability

If the product does not match the description on the Platform, your remedy is to request a refund as per our Refund & Cancellation Policy. To the extent permitted by law, we disclaim liability for any other losses. You agree to indemnify and hold harmless the Merchant and its affiliates, agents, and representatives from claims, losses, and expenses arising from your breach of these Terms.

9. Reviews

If we provide areas to leave reviews, reviews must be based on firsthand experience and must not contain abusive, hateful, discriminatory, false, or misleading content. We may accept, reject, or remove reviews at our discretion. By posting a review, you grant us a non-exclusive, worldwide, royalty-free licence to display and use it.

10. Governing law and dispute resolution

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction. Any dispute arising out of these Terms ("Dispute") shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. Within 30 days of a notice of Dispute, the parties shall mutually appoint a sole arbitrator; failing that, the arbitrator shall be appointed as per the Act. The seat of arbitration shall be India, proceedings shall be in English, and the award shall be final and binding. This does not prevent either party from seeking injunctive relief from appropriate courts.

12. Disclaimer

• By initiating a Transaction, you enter into a legally binding contract with us to purchase the product and agree to pay the listed price through legitimate sources of funds and accepted Payment Instruments.
• Payments are processed by a secure third-party payment gateway. Information you provide may be shared with third parties if required for fraud verification or by law, regulation, or court order.
• We are not liable for any loss arising from unauthorized use of your Payment Instrument, or from the decline of authorization for any Transaction, malfunction, or errors.
• Keep any order ID, password, or security information confidential.
• Content on the Platform is for general information only and does not amount to advice from us.
• Links to third-party websites are for information only and are not an endorsement.
• We do not guarantee that the Platform will be free from bugs or viruses; please use your own virus protection.
